Falconer says Dafonte struggled onto the property of a neighbour in the area and began banging on the door for help. At this point the Theriault brothers pulled him away from the door and continued to pummel him with the pipe and their fists. Dafonte collapsed onto the hood of a vehicle in the neighbour’s driveway. Then, according to Falconer, Christian Theriault called the police and informed them that he and his brother, an off-duty police officer, had restrained someone who had committed a theft. Falconer says Michael Theriault can be heard in the background of the recording telling Dafonte, for the first time, that he is under arrest.

Dafonte never stopped fighting for his life. He managed to reach into his pocket for his cell phone and dialled 911. He claims Constable Theriault took the phone away before he could speak and that Theriault told the 911 dispatcher that he was a police officer and Dafonte was in his custody. The officer knelt down on Dafonte’s head and neck in order to restrain him. When Dafonte repeatedly told Theriault he was having trouble breathing, he says the officer replied, “Shut the fuck up.”

The calls to 911 prompted a response from the local police force. Officers from the Durham Regional Police Service arrived to evaluate the scene. According to Falconer, Dafonte was bleeding heavily, and pieces of his skin remained on the hood of the neighbour’s car. His left eye was completely dislodged from its socket. This is the condition in which Durham police found Dafonte, and his complaint alleges that officers immediately treated him as the assailant instead of the victim of the attack:

33. DRPS Officers Jennifer Bowler and Barbara Zabdyr were the first DRPS officers to arrive on the scene. When they arrived Dafonte was face down on the ground. PC Bowler placed Dafonte in handcuffs and told him to stand up. Dafonte advised that he couldn’t stand and so PC Bowler dragged Dafonte up from the ground by the handcuffs and placed his upper torso over the hood of the vehicle parked in the driveway of [address redacted].
